| The following Terms and Conditions
relate to the download and / or use of all Hibyte Software
technologies and derivatives. |

| 1. You are not
required to accept this License, since you have not signed
it. However, nothing else grants you permission to use
or posses any Hibyte technologies or any derivative works.
If you do not accept the terms of this license, you should
cease using any Hibyte technology or derivaties immediately
and destroy any of which you are in possesion of. |

| 2. You may not
copy, sublicense, or distribute any Hibyte Technology
or any derivative without explicit prior permission from
Hibyte. Any attempt to otherwise copy, sublicense or distribute
Hibyte technologies or any derivative will automatically
terminate your rights under this License, and is prohibited
by Law. |

| 3. Hibyte technologies
are supplied 'as is', without warranty of any kind, either
expressed or implied, including, but not limited to, the
implied warranties of merchantability and fitness for
a particular purpose. The entire risk as to the quality
and performance of the program is with you. Should the
program prove defective, you assume the cost of necessary
services, repair or correction. |

| 4. In no event
will Hibyte be liable to you for damages, including any
general, special, incidental or consequential damages
arising out of the use or inability to use Hibyte technologies,
including but not limited to loss of data or data being
rendered inaccurate or loss sustained by you or third
parties or a failure Hibyte technologies to operate with
any other programs, even if the possibility of such damages
has been advised. |

| 5. You understand
that the software components may not have been tested
and may have errors and produce unexpected results. Your
use of any software component is entirely at your own
risk. |

| 6. Hibyte Software
asserts its copyright, title, sole ownership and associated
rights on all Hibyte technologies and derivatives, including
but not limited to those developed by Hibyte Limited and
any programmer under its employ, past, present and future.
Any user of Hibyte Software technologies or derivatives
is deemed a licensee under the terms of this license and
must comply with the terms herein. |

| 7. You are free
to modify Hibyte Software technologies, allbeit entirely
at your own risk. Any modified technology is deemed a
derivative work and is subject to the terms of this license.
You agree to submit to any request by Hibyte Software
to supply full copies of any modifications made to our
technologies, with full annotation and other documentation
on demand and without delay. |

| 8. You understand
that support and installation is not included by default
with the supply of any Hibyte Software technologies, and
that these are services available for purchase separately,
if required. |

| 9. You understand
that due to circumstances beyond our control, Hibyte is
unlikely to be able to assist in modifications and other
complex support related issues. Users are free to approach
other developers for assistance as required, on the understanding
that Hibyte retains the copyright on any derivative work,
and that its use falls under the terms of this license. |

| 10. You understand
that requests for refunds will only be considered once
all premium support options have been exhausted, and Hibyte
Software is satisfied that your setup is incompatible
with the solution purchased. In these rare cases the refund
will also include the cost of any Hibyte premium support
purchased. Once refunded, you understand that all trace
of your purchased software and any derivatives must be
destroyed, and your license to use said software is revoked. |

| 11. If any part
or any provision of this agreement shall to any extent
prove invalid or unenforceable in law, including the laws
of the European Union, the remainder of such provision
and all other provisions of this agreement shall remain
valid and enforceable to the fullest extent permissible
by law, and such provision shall be deemed to be omitted
from this agreement to the extent of such invalidity or
unenforceability. The remainder of this agreement shall
continue in full force and effect and the licensee shall
negotiate in good faith to replace the invalid or unenforceable
provision with a valid, legal and enforceable provision
which has an effect as close as possible to the provision
or terms being replaced. |

| 12. This Agreement
shall be governed by and construed in accordance with
English Law and shall be subject to the jurisdiction of
the Courts of England. |
